These Terms and Conditions govern all offers, sales, and agreements concluded through the online store at sdmparts.eu.

2. Products, Pricing & Orders

  1. Product Compatibility: Parts listed on sdmparts.eu are specified with OEM or manufacturer part numbers where applicable. Customers are responsible for verifying fitment and technical compatibility prior to completing a purchase.

  2. Pricing & Price Adjustments: Prices displayed on product pages are final at the time of order placement. Prices are subject to adjustment without prior notice for future orders. Previous purchase prices or quotes create no obligation to maintain identical pricing on subsequent or repeat orders.

  3. Order Acceptance: Receipt of an automated order confirmation email does not constitute final contract acceptance. We reserve the right to cancel orders in cases of stock unavailability, pricing errors, or fraud detection.

4. Shipping & Delivery

  1. Shipping Destinations: We ship to most EU member states, as well as Norway, Switzerland, and the United Arab Emirates (UAE). We currently do not ship to the United Kingdom due to local VAT regulations.

  2. Dispatch & Processing: Orders placed on business days before 12:00 CET are usually dispatched on the same day. Dispatch and shipping take place Monday through Friday only (excluding public holidays).

  4. Risk of Loss: For consumer purchases (B2C), the risk of loss or damage transfers upon physical delivery to the recipient. For business purchases (B2B), risk transfers upon handover of the goods to the transport carrier.

5. Right of Withdrawal & Returns (Consumers / B2C)

Under EU consumer protection regulations, consumer buyers (B2C) residing within the European Union / EEA have the right to withdraw from the contract within 30 days without giving any reason.

  1. Withdrawal Period: The 30-day cancellation window begins on the day you (or a designated third party other than the carrier) receive physical possession of the goods.

  2. Initiating a Return: All returns must be registered and processed through our designated portal:

  3. Condition of Goods: Returned items must be unused, uninstalled, in their original condition, and in their original packaging. For safety reasons, gas components that show signs of mounting, installation, or gas flow cannot be accepted for standard return or refund unless covered by a valid defect claim.

  4. Return Shipping Costs: Unless otherwise specified, the customer bears the direct costs of returning the goods.

  5. Refunds: Refunds will be issued via the original payment method within 30 days after we receive the returned items or proof of return shipment.

  6. B2B & Account Exclusions: Purchases executed by commercial accounts, registered trade accounts, or under negotiated commercial arrangements are excluded from the statutory 30-day right of withdrawal.

6. Statutory Warranty & Defective Goods

  1. Legal Guarantee: Consumer goods are subject to statutory warranty rights under applicable EU and national laws covering defects present at the time of delivery.

  2. Filing a Claim: If a part arrives defective or develops a fault during proper operation within the legal warranty period, contact sales@sdmparts.eu with a description of the defect and supporting photos/videos.

  3. Remedies: Confirmed defective items will be repaired, replaced, or refunded in accordance with applicable statutory rights.

7. Installation, Safety & Limitation of Liability

  1. Gas Safety & Installation: Parts sold on sdmparts.eu are designed for gas fireplaces and gas heating equipment. Installation and maintenance must be carried out in strict accordance with manufacturer specifications, applicable gas safety regulations, and local building codes.

  2. Exclusion of Consequential Costs: The warranty and liability of sdmparts.eu are limited strictly to the replacement, repair, or refund of the purchase price of the supplied component. Under no circumstances shall sdmparts.eu be liable for external labor charges, technician service fees, diagnostic hours, travel or fuel expenses, or fireplace downtime incurred by the customer or third parties.

  3. Maximum Liability: To the maximum extent permitted by applicable law, our total financial liability for any claim shall not exceed the net purchase price paid for the specific item in question.

8. Online Dispute Resolution (ODR)

EU consumers may access the European Commission’s Online Dispute Resolution platform for out-of-court dispute resolution: https://ec.europa.eu/consumers/odr.

9. Applicable Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Any legal disputes shall be submitted to the competent courts having jurisdiction over Neustift im Stubaital / Innsbruck, Austria, without prejudice to mandatory statutory consumer venue rights under EU law.
